EPA registration background
On February 15, 2018, the U.S. Environmental Protection Agency (EPA) and Amazon reached an agreement on the distribution of more than 2,000 unregistered and unlabeled pesticide products between 2013 and 2016. According to the agreement: Amazon will pay an administrative penalty of 1,215,700 US dollars and take measures to monitor and delete illegal pesticides on the platform. Since then, the Amazon platform has increased supervision to investigate and dealt with and found that pesticide/pesticide equipment products have huge potential violations. Starting from June 2018, they will be forced to remove non-compliant pesticide/pesticide equipment from the shelves until the products are compliant. . In January 2019, Amazon officially issued relevant rules to regulate platform stores. If the product does not obtain the EPA registration code, Amazon U.S. station does not allow the product to be put on the shelf. Therefore, the majority of customers need to register with EPA in advance to prevent the products from being unable to sell normally.
Amazon is prohibited from selling in the following situations:
-Unregistered products; -Sell fungicides products for non-US residents
-Products without EPA registration code and trade name
-The product is produced by a non-EPA trade name company, or the EPA trade name is not marked on the label, or false or misleading publicity is made
-Restricted use of products that cannot be sold, or products that are not used by the public
-The product has not been registered and filed with the EPA and the states.
-The product has false or misleading publicity, and the product slogan uses misleading words such as "safe", "non-toxic", "harmless", "non-toxic", and "pure natural"; product publicity is used to control and Relieve any diseases, infectious diseases, etc.
Common regulated devices
According to the Federal Insecticide, Fungicide, and Rodenticide Act (Federal Insecticide, Fungicide, and Rodenticide Act),all devices that can sterilize, disinfect, inactivate or trap harmful organisms, such as insects, mice, birds, bacteria, fungi, microorganisms, etc., Both requre EPA registration before they can be sold in the United States. Commonly controlled products such as: ultraviolet disinfection lamp, ozone disinfector, UV disinfector, UV mosquito killer, ultrasonic insect repellent equipment, UV water filter, UV air filter, high frequency bird repellent, electronic mouse repellent.
However, products can be exempted from EPA registration in the following circumstances:
-Articles are treated with EPA-registered antibacterial agents, which will not cause any public health and safety in the articles, or the antibacterial agents are only used to protect the product itself;
-The product uses the Minimum risk list in the active ingredients and excipients (inert ingredients), and meets the labeling requirements set by the EPA.
-Human and veterinary drugs regulated by FDA
Of course, some pesticide products are also dangerous goods and must meet the requirements of dangerous goods labeling
EPA registration process:
It should be noted that EPA registration must be applied by local residents or companies in the United States. For all companies outside the United States, they cannot apply directly. So lke our Chinese manufacturers, you must entrust an American agent to do it. The US agent must be an individual with permanent residency in the US or an agency authorized by the EPA.
How EPA regulates products
Although the EPA does not require the validity report of the product, the EPA regularly checks the label of the product, so manufacturers need to design the label in accordance with the EPA's requirements. In addition, the EPA also requires applicants to complete the previous year's sales report within 30 days of obtaining the registration code, and from the second year onwards, they must complete the annual report before March of each year. Regarding labeling requirements, manufacturers must apply insecticide and sterilization product labels in conspicuous places such as packaging and instructions. The label must indicate that the product meets EPA requirements and indicate the EPA Establishment Number. At the same time, make strict and correct claims on the performance of the product.
