Deepening the reform of "delegating control, delegating management, and serving the service" and creating a market-oriented legalized international business environment is an important starting point for doing a good job in the "six stability" and implementing the "six guarantees" task. In recent years, the "decentralization, regulation, and service" reform has been intensified, which has effectively stimulated the vitality of market players and social creativity. However, there are still some outstanding issues that are highly concerned by companies and the public and need to be resolved urgently. In order to further deepen the reform of "delegation, management, and service", do a good job in the "six stability" and "six guarantees", and promote high-quality development, with the approval of the State Council, the following opinions are hereby put forward.
1. General requirements
(1) Guiding ideology. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, fully implement the spirit of the 19th National Congress of the Communist Party of China and the 2nd, 3rd, 4th, and 5th Plenary Sessions of the 19th National Congress of the Communist Party of China, earnestly implement the decisions and deployments of the Party Central Committee and the State Council, and stand on the new development stage. (2) Basic principles.
Adhere to goal-oriented and comprehensive policy implementation. Focusing on key areas such as stabilizing and expanding employment, cultivating market players, expanding effective investment, promoting consumption, stabilizing foreign trade and foreign investment, and ensuring basic people’s livelihood, with pragmatic and effective policies and reform measures to enhance the sense of gain for enterprises and the public.
Adhere to problem orientation and seek practical results. Focusing on the difficulties and obstacles of enterprises and the masses in business and entrepreneurship, continue to "bite hard bones", adhere to the combination of decentralization and management, and focus on clearing up unreasonable restrictions on market entities, implement more effective supervision, continue to optimize government services, and continue to increase the amount of reform.
Insist on system integration and coordinated advancement. Adhere to the system concept, strengthen the organic connection and overall planning of reforms in various fields, promote the linkage between the central and local governments, strengthen coordination and cooperation between departments, promote reforms based on the entire life cycle and the entire industry chain, improve supporting policies, and expand integration Effect and enhance the endogenous power of development.
2. Further promote the optimization of the employment environment
(3) Promote lowering the employment threshold. Further sort out and reduce the number of vocational qualifications for admission, cancel vocational qualifications such as rural veterinarians, survey and design registered oil and gas engineers, promote socialized vocational skill level recognition, and continue to dynamically optimize the national vocational qualification catalog. Reasonably reduce or abolish the working life requirements of some vocational qualification examinations for admission. Further regulate the access of small and micro e-commerce, and scientifically define the standards of "convenient labor activities" and "sporadic small-value transaction activities" in the "E-commerce Law of the People's Republic of China". (4) Support the promotion of vocational skills. Establish a dynamic adjustment mechanism for vocational skills training subsidy standards, and determine the training subsidy standards scientifically and reasonably. Broaden the use of vocational skills training funds. Extend the implementation period of the work-for-training policy and simplify the materials for enterprises to apply for work-for-training subsidies. Strengthen the vocational skills training for employees in the housekeeping, pension and other industries, and comprehensively improve their employability. Innovatively carry out "industry-industry cooperation", encourage industry associations, cross-enterprise training centers and other organizations to organize small, medium and micro enterprises to carry out apprenticeship training, and encourage various regions to explore various forms of training such as project-based training. Adopt methods such as optimizing examination and approval services and exploring the implementation of the notification and commitment system to facilitate the establishment of various vocational training institutions. Strengthen the supervision and guidance of platform companies, promote fair and orderly competition, promote platform companies to improve service agreements and transaction rules in accordance with laws and regulations, set reasonable charging standards, improve management services, and support the healthy development of new employment forms. Implement and improve fiscal, taxation, and financial support policies, give full play to the leading role of the dual innovation demonstration base, and support key groups such as college graduates, veterans, and returning migrant workers to start businesses and find jobs. Improve social security policies and measures for flexible employees, promote the liberalization of household registration restrictions on participating in social insurance in places of employment, accelerate the promotion of occupational injury protection trials, expand the coverage of work injury insurance, and safeguard the legitimate rights and interests of flexible employees. 3. Further promote the reduction of the burden on market entities
(6) Improve the service mechanism for benefiting enterprises. Promote effective methods of direct fiscal funds, and study the inclusion of qualified and favorable enterprise funds into the direct mechanism. Optimize the tax rebate review procedures for the treasury, and gradually realize intelligent and automated processing. Promote the realization of "cross-provincial payment" in all areas of non-tax revenue. Streamline the procedures and procedures for enjoying preferential tax and fee policies, and continue to expand the scope of "self-discrimination, self-declaration, and subsequent supervision". (7) Standardize and improve intermediary services. Strictly investigate and deal with violations such as the establishment of hidden barriers for specific intermediary agencies’ monopoly services by administrative agencies or the transfer of their own administrative examination and approval intermediary service fees to enterprises. Strictly regulate the intermediary service items set by the departments of the State Council and local governments. Lower the barriers to entry for intermediary services in accordance with the law, break down industry barriers, break local protections, introduce competition mechanisms, promote the improvement of the quality of intermediary services, and establish a reasonable pricing mechanism. Strengthen the supervision of intermediary agencies, promote the disclosure of service conditions, procedures, time limits, and charging standards for intermediary agencies, and resolutely investigate and deal with arbitrary charges and price increases in disguise. Clean up norms involving the evaluation system of certification, and promote the transformation to a unified national certification system. Further deepen the reform of the investment approval system, simplify and integrate the application procedures for investment projects, promote the implementation of the enterprise investment project commitment system, and optimize the approval process for major investment projects in transportation, water conservancy, energy and other fields. Encourage all regions to promote the reform of "standard land" transfer, scientifically construct a "standard land" transfer indicator system, simplify and optimize the land supply process of industrial projects, reduce the time for land supply, and reduce the operating cost of investment projects. Promote the interconnection and data sharing between the online approval and supervision platform for investment projects and the relevant approval systems to avoid repeated filing by enterprises and repeated verification by departments. Support all regions to increase the limit of construction permits for construction projects based on actual conditions, and implement "list system + informed commitment system" for simple and low-risk construction projects. Study and formulate institutional documents for the approval and management of the whole process of construction projects, establish and improve the approval and supervision and management mechanism of construction projects, strengthen the approval behavior and time management of the whole process, standardize pre-examination, construction drawing review and other links to prevent extracorporeal circulation. (12) Remove hidden barriers to consumption. Orderly cancel some administrative restrictions on consumer purchases to release consumption potential. Accelerate the revision of the "Measures for the Administration of the Circulation of Second-hand Vehicles", push all regions to thoroughly clean up restrictions on the movement of second-hand vehicles set up in violation of regulations, and relax the operating conditions for second-hand vehicles. Standardize the qualification certification of scrapped motor vehicle recycling and dismantling enterprises, support qualified enterprises to enter the recycling and dismantling market, and investigate and deal with illegal dismantling behaviors in accordance with the law. Encourage all regions to appropriately relax market access for tourist homestays and promote the implementation of industry standards for tourist homestays. Develop guidelines for approval procedures for cross-regional tour performances, optimize the approval process, and provide convenience for performance business units to conduct business across regions. (13) Facilitate market access for new products. For new technologies and new products that are urgently needed by the market and high consumer demand, the national standards shall be applied first to formulate fast procedures, simplify the process of standard formulation and revision, and shorten the release cycle. Before the promulgation of relevant national standards, social organizations are encouraged to formulate and publish group standards that meet the needs of the market and innovation, and enterprises are encouraged to formulate competitive corporate standards and self-declare to the public, so as to promote the rapid entry of new technologies and products into the market. Accelerate the unification of regulations on technological processes and circulation rules for export commodities and domestic trade commodities, promote the "same line, same standard and same quality" of domestic and foreign trade products, and remove systemic obstacles that restrict the transfer of export commodities to domestic sales. Continue to expand the scope of pilot cities for cross-border e-commerce retail imports, and adjust and expand the list of cross-border e-commerce retail imports. 6. Further promote the stabilization of foreign trade and foreign investment
(14) Continue to optimize the foreign investment environment. Support foreign-funded enterprises to better participate in the formulation of national and industry standards. Optimize the foreign investment information reporting system, improve the functions of the corporate registration system and corporate credit information publicity system, strengthen reporting guidance, and reduce the reporting burden of enterprises. Optimize customs risk control rules, promote scientific random control, improve the accuracy of manual analysis and control, and reduce the inspection rate of law-abiding and compliant enterprises and low-risk commodities. Deepen the reform of the inspection and supervision model of import and export commodities, and actively promote the institutionalization of the acceptance of third-party inspection results. Encourage operators such as tally, tugboats, and commissioned inspections to enter the market to promote fair competition. Improve the service rules for container cleaning and repair, and clean up and standardize the fees for container cleaning and repairing outside the port and railway transportation closing fees. (17) Innovate the supply of elderly care and medical services. Promote the reform of publicly-owned and privately-run public pension institutions, introduce social capital and professional management service agencies, revitalize idle bed resources, and open to other disabled, demented, and senior citizens based on the centralized support of disabled and semi-disabled people . Promote the cancellation of clinic setting approval, and promote the change of clinic practice registration from approval to filing. Promote the cancellation of the qualification classification of occupational health technical service institutions to facilitate market access. On the premise of ensuring the authenticity and reliability of the source of electronic prescriptions, online sales of prescription drugs other than those under special state management are allowed. (18) Improve the accuracy of social assistance. Support all regions to promote the sharing of relevant data of civil affairs, human resources and social security, disabled people’s federations, medical insurance, rural revitalization and other departments and units, and use modern information technology such as big data to establish an active discovery mechanism and dynamic adjustment mechanism for people in need, optimize service procedures, and shorten processing The time limit is to realize early detection and early intervention of problems in the field of people's livelihood protection, to ensure that eligible people in difficulties receive timely assistance, and to prevent problems such as illegal collars and rent-seeking. Implement a management system for the list of certification items, and no certification should be requested from the enterprise and the public outside the list. If it is really necessary to provide a certificate, the name, purpose, basis, requesting unit, issuing unit and other information of the certificate shall be notified. Focusing on safeguarding and improving people's livelihood, we will promote more "trans-provincial services". Adhere to the parallel of traditional service methods and intelligent service innovation, and effectively solve the outstanding difficulties encountered by special groups such as the elderly in the use of intelligent technology. 8. Further strengthen supervision during and after the event
(20) Strengthen the supervision of cancellation and decentralization matters. Adhere to the combination of decentralization and management, and take effective supervision as a necessary guarantee for streamlining administration and decentralization, and promote government management to engage in pre-approval and shift more to mid-event and post-event supervision. The cancellation and decentralization of administrative licensing matters shall be formulated by the competent department in conjunction with relevant departments. Sort out the key supervision matters within the scope of responsibility, focus on managing "one thing" and implement comprehensive supervision. Strengthen the risk assessment of daily supervision matters, implement hierarchical and classified supervision, and strengthen supervision of high-risk links. It is necessary to strictly supervise the lives and health of the people and public safety, and resolutely maintain the bottom line of safety. To implement inclusive and prudent supervision of new industries and new formats, guide and regulate their healthy development. Improve the national integrated online supervision platform, promote the sharing of supervision information, accelerate the formation of unified supervision big data, strengthen the comprehensive application of supervision information, and improve the quality and efficiency of supervision. (22) Strictly regulate administrative law enforcement. Formulate and issue guidelines for further standardizing the benchmark system of administrative discretion, urge all regions and departments to clarify the types and extent of administrative discretion, standardize application procedures, and correct irregularities in administrative law enforcement such as penalties. Encourage all regions to establish flexible law enforcement checklist management systems in accordance with laws and regulations, and use administrative coercive measures with caution and less use of minor violations to prevent them from being shut down and managed by fines. Nine, safeguard measures
(23) Improve the evaluation mechanism of enterprises and the masses. Adhere to the perception and satisfaction of enterprises and the public as the criteria for judging the effectiveness of reforms, and rely on the national integrated government service platform and China Government Network to establish a normalized mechanism for enterprises and the public to evaluate reform measures at the national level. Timely publicize the evaluation results, strengthen the rectification of bad reviews, and form a closed loop of work that integrates evaluation, feedback, and rectification, so as to achieve mass participation, social evaluation, and market recognition. All regions should establish a social evaluation mechanism for reform initiatives at the local level.
(Twenty-four) Strengthen organization and implementation. All regions and departments must attach great importance to timely study and solve new situations and new problems arising in the reform of "delegation, management, and service", and earnestly achieve vitality, fairness, and efficiency of service. It is necessary to formulate implementation plans in accordance with laws and regulations based on actual conditions, introduce specific policies and measures, and implement them item by item.
