The CNCA expressly requires that after obtaining the ISO9001 certificate, the enterprise must accept the annual supervision and inspection of the certification company, and expressly stipulates the annual inspection fee. Some customers think that the annual review fee is too high, so it is better not to wait until the certificate expires and re-apply. It is this concept that causes frequent suspension or revocation of certificates. In fact, this is very risky, because according to China's certification and accreditation regulations, if the certification certificate is revoked, the company is likely to leave a bad record on the small blackboard of the China Certification and Accreditation Association. Even if you reapply for certification, The probability of passing will also be greatly reduced.

If the certification body fails to accept the ISO annual review after an extension of 3 months, the certification body has the right to suspend the certificate in the background of the CNCA. If the customer needs to resume within three months after the suspension, in addition to the corresponding annual review fee, an additional resumption fee must also be paid. After three months, the certification body has the right to report to the CNCA to announce the revocation or effectiveness of the certificate. If customers want to recover, they must reapply for certification. It can be said that the gain is more than the loss.

First of all, after the company’s ISO system certification expires, it is not illegal, but it does not comply with the relevant regulations on the use of the certificate. If it is found, the bidding qualification will be cancelled.

Article 14: The state implements an enterprise quality system certification system in accordance with internationally accepted quality management standards. Enterprises can apply for enterprise quality system certification to certification bodies recognized by the product quality supervision department of the State Council or authorized by the product quality supervision department of the State Council on the principle of voluntariness. The certification body shall issue an enterprise quality system certification certificate if the certification is qualified.

The country implements a product quality certification system with reference to international advanced product standards and technical requirements. Enterprises may apply for product quality certification to certification bodies recognized by the product quality supervision department of the State Council or authorized by the product quality supervision department of the State Council on a voluntary basis. Those who have passed the certification shall be issued a product quality certification certificate by the certification body, allowing the enterprise to use the product quality certification mark on the product or its packaging.

Article 53 Anyone who falsifies the place of origin of a product, forges or fraudulently uses the name and address of another person’s factory, or forges or fraudulently uses certification marks and other quality marks, shall be ordered to make corrections, the illegally produced and sold products shall be confiscated, and the illegally produced or sold products shall be confiscated. Fines below the equivalent value of the goods; if there are illegal gains, the illegal gains shall be confiscated; if the circumstances are serious, the business license shall be revoked.

Article 59: Anyone who falsely publicizes product quality in advertisements, deceives and misleads consumers, shall be investigated for legal responsibility in accordance with the provisions of the Advertising Law of the People's Republic of China.

Therefore, for a factory or enterprise, when the certificate expires, you must not take the risk to use it in violation of the regulations, otherwise you will face the risk of being punished.
