1. The basic situation of quality certification system construction

(1) Overview of quality certification.



Quality certification is a basic system for strengthening quality management and improving market efficiency under the conditions of a market economy. It is an internationally accepted quality management tool and trade facilitation tool, and an important part of the national quality infrastructure. Its essential attribute is "transmission of trust, service development", with the typical characteristics of marketization and internationalization. It is called the "physical examination certificate" of quality management, the "letter of credit" of market economy, and the "passport" of international trade.

Since the 18th National Congress of the Communist Party of China, General Secretary Xi Jinping has made important discussions and important instructions on quality certification many times. The Party Central Committee and the State Council have made a series of decisions and arrangements, and successively issued the "Guiding Opinions of the CPC Central Committee and the State Council on Carrying out Quality Improvement Actions" (Chinese Fa [2018] No. 24), "Opinions of the State Council on Strengthening the Construction of Quality Certification System to Promote Total Quality Management" (Guo Fa [2018] No. 3) and other important documents. The General Administration of Market Supervision, in conjunction with various departments, actively implement the decisions and deployments of the Party Central Committee and the State Council, centering on "marketization, internationalization, specialization, intensification, and standardization", comprehensively optimize the supply of quality certification services, strive to improve the level of quality certification work, and promote the industry Quality development and strengthening market supervision have played their due role.

(2) The status quo of my country's quality certification system.

In accordance with internationally accepted rules and my country’s development reality, CNCA has constructed a quality certification system that is fully in line with the international standards, serving the country’s reform and opening up and economic and social development in all aspects, and has played a positive role that attracts attention.

1. The legal system. A legal and regulatory system centered on the "Regulations on Certification and Accreditation of the People's Republic of China" (hereinafter referred to as "Regulations on Certification and Accreditation") has been established. At present, 19 laws, 17 administrative regulations, and 14 regulations have been clearly written into the terms of certification and accreditation.

2. Institutional system. In accordance with international rules and national conditions, a certification system combining compulsory and voluntary nature has been established, as well as management systems such as certification body approval, mandatory certification implementation agency designation, and certification personnel registration system, which comprehensively cover quality certification activities. At present, compulsory product certification covers a total of 103 products in 17 categories, and voluntary certification includes a total of 49 sub-categories in 3 categories of products, services, and management systems.

 3. Organizational system. In accordance with the principle of “unified management and joint implementation”, an inter-ministerial joint meeting composed of the State Administration for Market Supervision (CNCA) as the competent authority, relevant departments and units as the deliberative and coordinating body, and the market supervision departments across the country as the main body of law enforcement and supervision, The certification and accreditation inspection and testing agency is the organization system of the implementation subject.

4. Supervision system. Established a five-in-one supervision system of "legal norms, administrative supervision, accreditation constraints, industry self-discipline, and social supervision", and implemented access management and interim and ex post supervision for certification agencies, accreditation agencies, and inspection and testing agencies.

 5. Standard system. All 36 conformity assessment international standards have been equivalently converted into national standards, 69 national standards and 165 industry standards have been issued, and the evaluation basis has been unified and standardized.

6. Mutual recognition system for international cooperation. It has joined 21 certification and accreditation international organizations, and signed 14 multilateral mutual recognition agreements and 123 bilateral cooperation mutual recognition arrangements. In addition, my country has established bilateral cooperative relations with more than 30 countries and regions along the “Belt and Road”, providing facilitation arrangements for serving the construction of the “Belt and Road”.

2. Development of key tasks

(1) Continue to deepen the reform of decentralization, regulation, and service to stimulate the vitality of the certification market.

One is to improve the qualification examination and approval system of certification bodies. The State Administration for Market Regulation actively implements the reform spirit of the State Council’s "Separation of Licenses and Licenses", cancels the approval system designated by inspection agencies for compulsory product certification activities within the scope of the National Free Trade Pilot Zone, and implements notification commitments and optimization standards for certification agencies based on risk levels. For classified management of incoming services, the approval time limit has been reduced from the legal 45 working days to 17 working days on average.

The second is to deepen the reform of the compulsory product certification system. Closely follow the essential attributes of the "bottom line" of compulsory product certification, adhere to problem-oriented, and improve the compulsory product certification (CCC certification) system in accordance with the principle of necessity and minimization. From 2018 to 2019, 62 products were transferred out of the catalog in four batches, reducing 112,000 certificates; the "self-declaration" evaluation method of production enterprises was introduced in the implementation of CCC certification. At present, a total of 19 products have been converted from the original third-party certification. Self-declaration, reduction of 210,000 certificates. Promote the transfer of production license to CCC certification in an orderly manner.

The third is to organize and promote the reconstruction of my country's food and agricultural product certification system. Carrying out research on the certification system of food and agricultural products in my country, completing the "Research Report on Comparative Analysis and Development Suggestions for China's Food and Agricultural Products Certification System", researching and proposing a work plan for restructuring the food and agricultural product certification system, and starting the regulation of the current food and agricultural product certification system , Integrate, adjust, and revise existing certification systems; explore the establishment of smart certification models based on modular combinations among different certification systems.

(2) Improve the level of certification service supply and promote high-quality economic development.

 The first is to promote high-end quality certification to promote the upgrading of products and services. Promote certification of organic products, good agricultural practices (GAP), hazard analysis and critical control points (HACCP) in the field of food and agricultural products, and promote certification of home appliances, smart appliances, and high-definition digital televisions in the field of consumer products. Together with the National Development and Reform Commission In the field of equipment manufacturing, the certification of urban rail transit equipment and transportation all-in-one card has been implemented, and more than 1,200 high-end quality product certification certificates have been issued; in the service industry, certifications such as health services, elderly services, and financial services have been implemented to guide the improvement of product and service quality, and service certification certificates When the State Administration for Market Supervision was established, the number of tickets increased rapidly from more than 5,000 to more than 20,000.

The second is to carry out quality management upgrades to help companies strengthen quality management. Promote the establishment of a quality management system certification system with industry characteristics in accordance with the needs of different industries such as aviation, railways, survey and design, and meteorology. Focus on helping small and micro enterprises to improve their quality management level, conduct quality special surveys on 15,052 small and micro enterprises, provide free quality certification training for 92,000 employees, and formulate 16 quality management system construction guidelines for small and micro enterprises to help them To solve the problem of quality management "pain points", the relevant results were released as the only topic of the General Administration at the special government press conference of the 16th China International SME Expo.

The third is to encourage energy conservation, environmental protection and green organic certification to serve the construction of ecological civilization. Work with the Ministry of Finance and the National Development and Reform Commission to adjust and optimize the implementation mechanism for government procurement of energy-saving products and environmentally-labeled products to promote the application of energy-saving and environmental protection certification. Accelerate the implementation of a unified green product certification system, launch green product certification pilot projects in the building materials, packaging and other industries and Huzhou, Zhejiang Province, and issue the first batch of green product certificates. Help 32 poverty-stricken areas pass certification to expand the market for organic agricultural products, explore a new mechanism for organic certification to help precision poverty alleviation, and make a special report on the relevant results at the National Rural Industry Revitalization Promotion Conference.

The fourth is to promote the construction of certification and testing systems in key areas to serve the implementation of major national strategies. Focusing on the cyber security strategy, we will work with the Central Cyberspace Administration of China and other departments to jointly promote the construction of a network security certification and testing system, establish APP (mobile phone mobile terminal) certification, data security management certification, and commercial password certification systems; focus on the military-civilian integration development strategy to accelerate the development of Beidou navigation Certification and testing system construction, organized 197 institutions to participate in the construction of military-civilian general inspection and testing system; provide certification and accreditation services around major national activities. Formulate the China International Import Expo compulsory certification implementation plan to facilitate the sales of exhibition products; the Beijing Winter Olympics Organizing Committee has obtained the certification of the sustainable management system for large-scale events, and the event hosting capacity has been internationally recognized.

The fifth is to cultivate regional quality brands and promote the transformation and upgrading of local economies. Actively guide local areas to pass third-party certification, and cultivate a number of regional quality brands such as "Made in Zhejiang", "Lishui Shangeng", "Shanghai Brand", "Taishan Quality" and "Mengzi Mark". Zhejiang Province has become the country's first comprehensive reform pilot province for certification, accreditation, inspection and testing, and more than 130 quality certification demonstration zones have been established throughout the country.

Sixth, optimize the development environment for industrial product quality certification and support the revitalization and development of the manufacturing industry. The Ministry of Industry and Information Technology actively promotes the improvement of the quality policy environment for separate policies in consumer products, equipment and raw materials industries, and refines the relevant standards of the quality management system in accordance with the characteristics of the communications, electronics, and aviation industries. In 2019, the Ministry of Industry and Information Technology issued the "Implementation Opinions on Promoting the Improvement of Manufacturing Product and Service Quality", which strengthened the domestic quality system capabilities in terms of improving the standard system, creating a high-quality and favorable price environment, and promoting enterprises to strengthen supply chain quality management. Construction needs and guidance.

The seventh is to strengthen the certification work in the field of production safety, and strengthen the safety assurance capabilities of high-risk industries. According to Article 75 of the Regulations on Certification and Accreditation, in order to standardize and strengthen the safety production management of enterprises in high-risk industries such as mines, hazardous chemicals, fireworks and firecrackers, the Emergency Management Department (formerly the State Administration of Work Safety) has mainly carried out two aspects of work: On the one hand, improve the establishment and review system of enterprise safety production standardization. To formulate and publish normative documents and review standards such as the "Basic Norms for Standardization of Enterprise Work Safety", "Management Measures for the Standardization Review of Work Safety in Non-coal Mines", "Management Measures for the Standardization Review of Work Safety for Hazardous Chemicals Practitioners", and stipulate corporate safety The core elements of the creation of production standardization and the content of the review unit’s conditions, review standards, review procedures, etc., have built a complete corporate safety production standardization creation and review rule system and working mechanism, which has effectively promoted the implementation and implementation of the main responsibility of corporate safety production. The standardization of enterprise safety production management has further strengthened the risk control and hidden danger investigation and management of high-risk industries such as mines, hazardous chemicals, fireworks and firecrackers, and played an important role in effectively curbing the occurrence of major accidents. On the other hand, scientifically standardize the qualification approval procedures of safety assessment institutions. Formulate and issue a series of standard safety evaluation industry standards, such as "Management Regulations for Safety Evaluation Institutions", "Management Measures for Safety Evaluation Testing and Inspection Institutions," and "General Rules for Safety Evaluation", so as to effectively control production safety risks and avoid production safety accidents. Certification agencies engaged in the comprehensive evaluation of production safety of mining, hazardous chemicals, and fireworks and firecrackers production and business units may obtain accreditation from accreditation agencies determined by the certification and accreditation supervision and management department of the State Council upon the recommendation of the Emergency Management Department.

The eighth is to improve the competence of certified practitioners. The State Administration for Market Regulation explores and conducts research on the reform of the certification personnel management system, promotes the establishment of a certification personnel professional qualification system, and urges the China Certification and Accreditation Association to strengthen personnel registration management, and promote the standardized management and professionalization of certification personnel. The Ministry of Human Resources and Social Security puts quality awareness throughout the work of vocational skills training, strengthens the standardization of vocational training, and strengthens the training of safety skills in high-risk industries. In conjunction with the emergency management department, the coal mine safety supervision bureau and other departments, the "Regarding Safety Skills in High-risk Industries "Implementation Opinions on the Enhancement Action Plan" to promote the substantial improvement of employees’ safety skills.

(3) Strengthen the supervision of the certification market and effectively maintain the credibility of certification.

At the beginning of its establishment, the State Administration of Market Supervision issued the "Notice on Strengthening the Supervision of the Certification and Testing Market" (Guo Shi Jian Certification [2018] No. 173), deployed a national market supervision system to centrally carry out special management of "certification chaos", and held A special press conference on the rectification of certification chaos announced the results of centralized rectification to the public. The second is to carry out punishment for dishonesty in the certification field. Establish a "blacklist" of untrustworthy, and unify the list of untrustworthy certification agencies and related untrustworthy information into the "National Enterprise Credit Information Disclosure Platform" of the State Administration for Market Regulation. Joint relevant departments to implement joint punishments for serious violations of law and trust in the fields of finance, taxation, and customs. Relying on the information system, carry out "Internet + supervision", comprehensively use "big data" means to improve supervision efficiency.

The third is to standardize the certification order of exported anti-epidemic materials. During the new crown pneumonia epidemic, the State Administration for Market Regulation thoroughly studied and implemented General Secretary Xi Jinping's important instructions, earnestly implemented the decisions and deployments of the Party Central Committee and the State Council, and quickly organized and carried out special rectification and assistance actions for certification activities in the field of epidemic prevention products. In terms of rectification, a total of 88,976 inspectors were dispatched, 1376 problem clues were found, 346 suspected illegal cases were filed for investigation, and more than 12.15 million fines were imposed. In terms of assistance, three editions of the "Guidelines for Access to Foreign Markets of Epidemic Prevention Products" were issued and qualified. The directory of competent certification agencies helps companies effectively respond to foreign market access requirements, promotes the smooth export of epidemic prevention products, and maintains national credibility.

The fourth is to strengthen the construction of certification supervision capacity. Carry out the "double random, one open" supervision and inspection in the field of certification to improve the effectiveness of supervision; the "Notice of the General Administration of Market Supervision on Strengthening the Work of Certification Supervision" (Guoshijian Certification [2018] No. 102) has further clarified market supervision at all levels The department’s certification supervision responsibilities, supervision mechanism, supervision focus, and supervision methods will give full play to the comprehensive law enforcement advantages of market supervision; compile the "Certification Supervision Training Materials", carry out online inspection training, and enhance the supervision and law enforcement capabilities of certification supervision teams at all levels.

(4) Deepen mutual recognition of international cooperation and enhance the international influence of my country's certification.

First, the areas of bilateral cooperation mechanisms have continued to deepen. Consolidate the China-Germany and China-Canada government certification and accreditation cooperation mechanism, carry out negotiations on the mutual recognition of conformity assessment between China and Norway and China-New Zealand (Zeeland), sign agricultural machinery certification cooperation agreements with the United Nations Asia-Pacific Economic and Social Commission and the Italian Agricultural Machinery Commission, and reach the mainland, Hong Kong and Macau electronics Mutual recognition of electrical products.

Second, the international influence of multilateral cooperation mechanisms continues to increase. Jointly promote certification and accreditation services "One Belt One Road" construction vision and action" three-year plan, signed cooperation documents with the competent authorities of Mongolia, Kyrgyzstan, Iran and other countries, carried out cooperation memorandum of understanding consultations with Myanmar, Saudi Arabia, UAE and other countries, and carried out international exchanges , Training, consultation and other cooperation projects.


3. Existing problems and next steps

While the quality certification work in my country is developing vigorously, there are also problems that need to be resolved. The social recognition and credibility of my country's quality certification reflected in your proposal are not high, the quality certification system is not sound, the quality certification supervision method is single, the supervision content is duplicated, and the certification agency is not strong.
